Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Aussie Broadband website (the "Site") and our lead intake form. The Site is operated by Aussie Broadband Limited (ABN 27 132 090 192) ("Aussie Broadband", "we", "us", "our"). Please read these Terms carefully before using the Site or submitting your details through the lead form.
2. Acceptance of Terms
By accessing the Site, submitting the lead intake form, or otherwise interacting with our online services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or submit the form.
3. Eligibility
You must be at least 18 years of age to use the Site and the lead intake form. The Site is intended for Australian residents and Australian-based businesses with an Australian service address. By submitting the form, you represent that you meet these eligibility requirements.
4. Lead Intake & Callbacks
Submitting the lead intake form creates a callback request. It is not an order, contract, or commitment to supply any service. Our team aims to call you back within 60 seconds during Australian business hours: Monday to Friday, 8:00am to 8:00pm AEST, and Saturday, 9:00am to 5:00pm AEST. Submissions made outside these hours are returned on the next business day.
You are responsible for providing accurate contact details. We may attempt to reach you by phone, email, or SMS using the information you provide.
5. SMS Communications & A2P Compliance
If you provide your mobile number and opt in to receive SMS from us, the following terms apply. SMS messages are sent on our behalf via Twilio across Australian mobile carriers (including Telstra, Optus and Vodafone).
Two separate consent categories
We maintain two distinct SMS consent categories:
- Transactional / account messages — callback confirmations, scheduling reminders, status updates and account notifications relating to your enquiry.
- Marketing messages — optional plan offers, promotions and new product information.
Opt-in
Consent is opt-in only. Each category has its own unchecked checkbox on the lead intake form. Checkboxes are never pre-selected, and SMS consent is never bundled with any other agreement or required to receive a callback.
Opt-out (STOP)
You may opt out at any time by replying STOP to any SMS we send. Your opt-out is processed immediately and no further messages will be sent to your number.
Help (HELP)
Reply HELP to any SMS for support information. We will reply with our support email support@aussiebroadband.com.au and our support phone number 1300 880 905.
Message frequency
Transactional message frequency varies based on the status of your enquiry. Marketing messages, if you opt in, are sent approximately 2 times per month.
Costs
Standard message and data rates may apply per your mobile carrier's plan. Aussie Broadband does not charge you to receive our SMS messages.
Carrier liability
Mobile carriers are not liable for delayed or undelivered SMS messages.
Non-sharing of SMS data
We will never share your mobile number or your SMS opt-in consent with third parties or affiliates for their own marketing purposes. SMS consent data is used solely to deliver the messages you opted in to.

6. Acceptable Use
You agree not to use the Site or the lead intake form to:
- Engage in abusive, harassing, threatening, or unlawful conduct.
- Submit false, misleading, or third-party contact information without authorisation.
- Use automated tools, bots, scrapers, or any means to access or copy the Site or its contents.
- Interfere with, disrupt, or attempt to gain unauthorised access to the Site or its underlying systems.
7. Intellectual Property
All content on the Site — including text, graphics, logos, plan information, and the "Aussie Broadband" name and marks — is owned by or licensed to Aussie Broadband and is protected by Australian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent. © Aussie Broadband Limited.
8. Disclaimer of Warranties
The Site and the lead intake form are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding the operation of the Site or the accuracy, completeness, or reliability of its content.
9. Limitation of Liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law, Aussie Broadband is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Site or the lead intake form.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable laws that cannot be excluded.
11. Changes to Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You and Aussie Broadband submit to the non-exclusive jurisdiction of the courts of Victoria and the federal courts of Australia.
